These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("you" or "your") and Delegate.fun ("Delegate.fun", "we", "us", or "our"). By accessing or using the Delegate.fun platform and services (the "Platform"), you agree that you have read, understood, and accepeted these Terms. You acknowledge and agree that you will be bound by and will comply with these Terms, as updated and amended from time to time. If you do not agree to these Terms, please do not use the Platform.

1. Risk Warning

Digital assets are highly volatile and involve significant risk. You are solely responsible for evaluating whether trading, holding, or using digital assets is suitable for you. Delegate.fun does not provide investment, financial, or legal advice. You should consult your own advisors before making any decisions. You are responsible for determining whether any investment, strategy, or related transaction is appropriate for you, and you are responsible for any associated loss or liability. We are not responsible for the decisions you make to buy, sell, hold, or sell Digital Assets based on the information or services provided by us, including any losses you incur arising from those decisions.

2. Eligibility

You must have the legal capacity to enter into these Terms and use the Platform.
You must not be located in, or a resident of, any jurisdiction where use of the Platform is prohibited by law.
If you use the Platform on behalf of an entity, you represent that you are authorized to bind that entity to these Terms.

3. Use of the Platform

We reserve the right to refuse or restrict access to the Platform at our sole discretion.
You must not use the Platform for any unlawful, abusive, or fraudulent activity.
You are responsible for maintaining the security of your wallet and account information.
You must not post or transmit any content that is abusive, defamatory, or violates any law or third-party rights.

4. Fees

You agree to pay all applicable fees as described on the Platform. We may update our fees at any time. It is your responsibility to review the current fee schedule before using the Platform.
You authorize us to deduct all applicable fees, commissions, and other charges that you owe from the Walllet that you connect to the Platform. You are responsible for ensuring you have sufficient digital assets to cover all charges owed.

5. Transactions

All transactions are final and cannot be reversed except as required by law or at our sole discretion.
You are responsible for ensuring you have sufficient digital assets to complete any transaction.
We may refuse to process any transaction that violates these Terms or applicable law.
We do not represent or warrant that any action by you on the delegate.fun platform will be completed successfully or within a specific time period.
You agree to give us permission (but agree to not require us) to keep a record of all Transaction information for its intended purposes, indefinitely until the purose is fulfilled.
You acknowledge and agree that delegate.fun is authorized by you (without any payment, penalty, or liability due by us, and provided such action is in compliance with Applicable Law) to cancel or void any such Transaction (as possible) deemed by us to be fraudulent, illegal, or otherwise in violation of these Terms.

6. Submission of Instructions

It is your responsibility to ensure that any instruction you submit is complete and accurate. We are not obligated to verify the accuracy, authenticity, or validity of any instruction, and we generally do not monitor or reject instructions that may be duplicates. However, if we have concerns about the accuracy or authenticity of an instruction, we may delay, refuse, or request additional information before acting on it.
Once you submit an instruction, it cannot be changed or withdrawn. An instruction is only considered received once it reaches our servers. Our records of all instructions are final and binding for all purposes.
By submitting an instruction, you authorize us to process the related transaction, including crediting or debiting your digital assets as directed. If your wallet does not have enough assets to complete a transaction (including all associated fees), we may refuse to process it. We may also refuse to act on any instruction as permitted by these Terms. You are responsible for maintaining sufficient assets in your wallet.
Instructions and information sent through the Platform or by email travel over the internet and may pass through public or international networks that are not fully secure. We cannot guarantee the security of such transmissions, and you accept the risks associated with sending instructions in this way.

7. Security

You are responsible for maintaining the security of your wallet and account information.
You are responsible for ensuring that your wallet is properly secured and that you have access to your private keys or other authentication methods by backing up and maintaing duplicate copies of any data or information you store or transfer through the Platform. We are not responsible for any losses or damages arising from your failure to comply with this clause.
You must keep information used to access the Platform secure against any attacks or unauthorized access.
It is a critical responsibility for you to monitor your account activity and promptly report any unauthorized access or suspicious activity. You acknowledge that any unauthorized access to your account may result in the loss or theft of your Digital Assets, and/or funds from your Wallet and any other associated Wallets or accounts.
In case of security breach, you agree to immediately notify us of the breach and cooperate with us in investigating the breach and taking appropriate action to mitigate the breach.

8. Terminations, suspensions, and limitations

We may terminate, suspend, or limit your access to the Platform at our sole discretion, with or without notice, for any reason or no reason, including if we believe you have violated these Terms.

9. Intellectual Property

All content, trademarks, and intellectual property on the Platform are owned by Delegate.fun or its licensors. You may not use, copy, or distribute any content from the Platform without our prior written consent.

10. Limitation of Liability

Delegate.fun is not liable for any losses or damages arising from your use of the Platform, including but not limited to loss of funds, data, or profits. The Platform is provided "as is" without warranties of any kind.

11. Indemnification

You agree to indemnify and hold harmless Delegate.fun and its affiliates from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

12. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page. Continued use of the Platform after changes are posted constitutes your acceptance of the new Terms.
